Withdrawal notices and model withdrawal form

These notices form part of my Store Terms and Conditions. You can withdraw online at app.berlinwalk.com/withdraw, by email or by post.

These notices apply to purchases from my Walk of Berlin store by consumers: individuals acting mainly for purposes outside their trade, business or profession. I offer the withdrawal rights described below to consumers regardless of their country of residence. Any greater rights under applicable mandatory law remain unaffected.

If your order contains both physical goods and digital files, the relevant notice applies to each product type. The start of the withdrawal period can therefore differ. Please identify the products to which your withdrawal relates.

1. Standard physical goods: prints and calendars

This notice applies to standard physical goods, including catalogue prints and calendars. Printing a standard item only after you order it does not remove your right of withdrawal. The separate exception for personalised physical goods is explained in section 2.

Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period expires 14 days after the day on which you, or a third party indicated by you other than the carrier, acquire physical possession of the goods. If you order several goods in one order and they are delivered separately, the period expires 14 days after the day on which you, or that third party, acquire physical possession of the last good. If a single good is delivered in several lots or pieces, the period expires 14 days after the day on which you, or that third party, acquire physical possession of the last lot or piece.

To exercise your right of withdrawal, you must inform me, Yusuf Ucuz, trading as Walk of Berlin, Marzahner Promenade 28, 12679 Berlin, Germany, telephone: +49 1522 8483662, email: info@walkofberlin.com, of your decision to withdraw from this contract by an unequivocal statement, for example a letter sent by post or an email. You may use the model withdrawal form in section 4, but it is not obligatory.

You may also exercise your right of withdrawal online at https://app.berlinwalk.com/withdraw. If you use this online function, I will send you an acknowledgement of receipt without delay on a durable medium, such as email. It will include the content of your withdrawal statement and the date and time it was received.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of your right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, I will reimburse all payments received from you, including the costs of delivery, without undue delay and no later than 14 days after the day on which I am informed of your decision to withdraw. This excludes supplementary delivery costs resulting from your choice of a type of delivery other than the least expensive standard delivery I offer.

I will make the reimbursement using the same means of payment you used for the initial transaction, unless you have expressly agreed otherwise. In any event, you will not incur any fees as a result of the reimbursement.

I may withhold reimbursement until I have received the goods back or you have supplied evidence that you have sent them back, whichever is earlier.

You must send back the goods or hand them over to Yusuf Ucuz, Walk of Berlin, Marzahner Promenade 28, 12679 Berlin, Germany, without undue delay and in any event no later than 14 days after the day on which you communicate your withdrawal from this contract to me. The deadline is met if you send the goods back before the 14-day period has expired. You do not need a return authorisation or my prior approval to exercise your right of withdrawal or return the goods.

You bear the direct cost of returning the goods when exercising this right of withdrawal. This does not apply to returns or other costs that I must bear under your statutory rights for defective or incorrectly supplied goods.

You are liable only for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning.

2. Exception for personalised physical goods

Under section 312g(2), no. 1 of the German Civil Code (BGB), there is no statutory right of withdrawal for the supply of goods that are not prefabricated and whose production is determined by an individual choice or decision by the consumer, or that are clearly tailored to the consumer's personal needs.

This exception applies to a physical "Your Berlin Street in 1928" print produced using your individual address, map point and text. It applies from the conclusion of the contract, including before production has started. Please check your choices and preview before placing your order.

This exception does not remove your statutory rights if the goods are defective or do not match the agreed specifications. It does not apply merely because a standard catalogue item is printed to order, and it does not apply to a printable digital file supplied without a physical medium. The digital-file notice below applies to those files. Any greater rights under applicable mandatory law remain unaffected.

3. Printable digital files

This notice applies to printable digital files supplied by download through my Walk of Berlin store, including a personalised printable file. It does not cover a physical print or purchases made through a separate product service with its own terms.

Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period expires 14 days after the day the contract is concluded.

You retain this right even if you receive access to, download or start using the file during the withdrawal period. I do not require you to waive this right in order to receive immediate access.

There are no goods to return. You will not be charged for access to or use of the digital file before withdrawal. After withdrawal, you must stop using the digital file and must not make it available to other people. I may disable further access to the file.

4. Model withdrawal form

Complete and return this form only if you wish to withdraw from the contract. You may instead send another unequivocal withdrawal statement. For a digital file, identify the file and your purchase in the description below.
