Digital Product Terms

These terms cover the digital products sold on this site: audio routes, PDF guides, digital planning tools, interactive photo episodes and visual episodes to watch at home. My separate Terms & Conditions cover participation in the live walking tours.

1. Who you are buying from

Yusuf Ucuz, sole trader, trading as Walk of Berlin, Marzahner Promenade 28, 12679 Berlin, Germany. Contact: info@walkofberlin.com. Full details are in the Impressum.

2. What you are buying

Digital content delivered online: self-guided audio routes with written directions and map links, downloadable MP3 files, PDF route cards and guides, generated planning documents, interactive photo episodes viewed in the browser, and visual episodes to watch at home in the browser (for example my Berlin Wall Virtual Walking Tour). Each product page states its exact contents, length and price. You are buying access to that content, not a place on a guided tour and not a ticket to any museum, memorial or attraction. Entrance fees, transport and opening hours at the places on a route are outside my control.

The Berlin Wall Virtual Walking Tour and the Berlin Wall Audio Walk are separate products, each €9.90. The Virtual Walking Tour includes ten visual stops and two bonus places to watch in your browser, with archive photographs, the 1989 Wall map, English audio and captions. It does not include the on-site audio walk, downloadable MP3 files or a PDF route guide. The Audio Walk includes the phone audio player, fourteen MP3 files and a PDF route guide for walking Bernauer Straße; it does not include the Virtual Walking Tour.

The Medieval Berlin Virtual Walking Tour is €9.90. It includes nine chapters and about 27 minutes of English narration, with captions, dated photographs, present-day and historical maps, and explanatory diagrams to watch in your browser. The narration uses an AI-generated voice. Browser access remains available for at least one year after purchase. This purchase does not include a self-guided audio walk, downloadable MP3 files or a PDF route guide. A refund can be requested within 14 days of purchase, even after watching.

The Berlin Audio Trio is €24.90 and includes three audio walks: the Berlin Wall, Hidden Berlin and Medieval Berlin, with their MP3 downloads and route guides. It does not include the Virtual Walking Tour. Separating these products does not remove content already included in an earlier Berlin Wall or Berlin Audio Trio purchase. Those purchases retain the access described when they were sold.

Visual episodes to watch at home stream in your browser. You need an internet connection to watch them, and they cannot be downloaded. I test them in the current versions of Chrome, Safari, Firefox and Edge, on desktop computers and on iOS and Android devices. I keep the visual episodes available to you for at least one year from the date of your purchase. The MP3 files and the PDF route cards or guides that come with a product are yours to keep: you can download them and use them offline with no time limit.

3. Prices and tax

All prices are shown in euro and are the final amount you pay. No value added tax is added at checkout: turnover is below the German small business threshold (Kleinunternehmerregelung, § 19 UStG). If that changes, the product pages will state the tax treatment then in force before you buy.

4. How the contract is made

You enter your email address and complete payment through Stripe. The contract is concluded when payment is confirmed and I send your delivery email. I do not store your card details; payment data is processed by Stripe Payments Europe, Ltd.

5. Delivery

Delivery is immediate and by email, to the address you enter at checkout. The email contains your access link and, where the product includes them, the downloadable MP3 archive and PDF. An interactive photo episode opens in your browser as soon as your payment is confirmed, and I also send its access link by email so you can open it again later. If the email has not arrived within one hour, check the spam folder first and then write to info@walkofberlin.com. I will resend or restore access. A failed delivery is not a reason to lose what you paid for.

6. Your right of withdrawal

As a consumer in the EU you have a statutory right to withdraw from this contract within 14 days without giving a reason. To exercise it, send me a clear statement within 14 days of your purchase, by email to info@walkofberlin.com or by post to Yusuf Ucuz, Marzahner Promenade 28, 12679 Berlin, Germany. You may use the model withdrawal form below, but you do not have to. Sending your statement before the 14 days have passed is enough. I do not ask you to waive this right in exchange for immediate access, so the right stays with you for the full 14 days even though the product is delivered straight away. I will refund the full amount using the same payment method, at no cost to you.

You can also withdraw with the withdrawal function: the button "Withdraw from contract (Vertrag widerrufen)" at the bottom of every product page, delivery page and thank-you page, or directly at app.berlinwalk.com/withdraw. Enter your name, your order number and the email address of your order, then press "Confirm withdrawal" with the code I send to that address. I confirm receipt by email straight away, with the date and time. Your access stays open until the refund is processed. Questions: info@walkofberlin.com.

7. What you may do with the content

One purchase grants access to the purchaser. You may download the files, keep them, print the route card and use them offline for your personal use. You may not forward the access link or files, resell them, publish them, or distribute them as your own product. The routes, written chapters and recordings remain my intellectual property.

Some products include photographs or other material by third-party creators under Creative Commons licences. The creator, source, licence link and any changes are credited beside the material and in the product's image credits. Those materials keep their own licences: the personal-use and no-redistribution rules above do not limit the copying, sharing or adaptation those licences allow. The purchase controls access to my experience, writing and recordings; it does not grant me exclusive rights over third-party material.

8. Accuracy and changes on the ground

I prepare each route from documented sources. The relevant product page states whether that route or revision has received an on-site access check. Streets close, buildings go under restoration and opening hours change. Every stop includes a map link so you can get around a closure. Where a well known story is legend rather than documented fact, the audio says so.

9. Liability

The routes run through public streets and public memorial grounds. You walk at your own risk and are responsible for your own traffic safety and for judging whether a route suits you. I am liable in cases of intent and gross negligence, and for injury to life, body or health, under German law. Liability for slight negligence is limited to foreseeable damage typical for this type of contract. Nothing here excludes liability that cannot be excluded by law.

10. Data

I use your email address to deliver the product, to restore access if something fails, and to handle a refund. Marketing email is only sent if you tick the optional consent box at checkout, and every one of those emails has an unsubscribe link. Details are in the Privacy Policy.

11. Governing law and disputes

German law applies. If you are a consumer resident in another EU country, this does not remove the protection of the mandatory consumer rules of your own country. The European Commission's Consumer Redress portal lists recognised dispute-resolution bodies and consumer options. I am not obliged and not willing to take part in dispute resolution proceedings before a consumer arbitration board, and I would rather settle anything directly by email.
